Terms of Service

Agreement

These Terms of Service ("Terms") govern your use of Fork & Kin (the "Service"). By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

The service

Fork & Kin lets you create cookbooks, save recipes, upload photos, and (on paid plans) invite family members to collaborate. We may change features, limits, or pricing with reasonable notice where practical. The Service is provided on an "as is" basis; see disclaimers below.

Accounts

You must provide accurate registration information and keep your password secure. You are responsible for activity under your account. Notify us promptly if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms or pose a security risk.

You must be old enough to form a binding contract where you live (typically 18, or the age of majority in your jurisdiction) to use the Service.

Your content

You retain ownership of recipes, photos, and other content you upload ("Your Content"). You grant us a limited license to host, store, display, and back up Your Content solely to operate the Service and share it with users you invite to your cookbooks.

You represent that you have the right to upload Your Content and that it does not infringe others' rights or violate law. Do not upload content that is illegal, harassing, malware, or that you do not have permission to share.

We may remove content or disable access if we reasonably believe it violates these Terms or applicable law.

Acceptable use

You agree not to:

  • Use the Service for unlawful purposes or to harm others
  • Attempt to access other users' accounts or data without permission
  • Probe, scan, or overload our systems (except authorized security research with our consent)
  • Resell or commercially exploit the Service without our written permission
  • Upload viruses or interfere with the Service's operation

Paid plans and billing

Some features require a paid "Family" subscription. Prices and limits are shown on our pricing page. Payments are handled by Stripe; their terms also apply to payment processing.

Subscriptions renew automatically until you cancel through the billing portal. Fees are generally non-refundable except where required by law or explicitly stated otherwise. If we change subscription pricing, we will provide notice as required before the change applies to you.

After cancellation, you typically retain access to saved recipes on applicable plans, but paid features (such as new invite links) may stop until you resubscribe, as described on the site.

Our intellectual property

The Service name, logo, software, and site design are owned by us or our licensors. These Terms do not grant you rights to our trademarks or code except as needed to use the Service in the normal way.

Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT YOUR CONTENT WILL NEVER BE LOST. YOU ARE RESPONSIBLE FOR MAINTAINING YOUR OWN BACKUPS OF IMPORTANT RECIPES.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) FIFTY U.S. DOLLARS ($50).

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.

Indemnity

You will defend and indemnify us against claims arising from Your Content, your use of the Service in violation of these Terms, or your violation of others' rights or applicable law.

Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or if we discontinue the Service. Sections that by nature should survive (such as disclaimers, limitation of liability, and indemnity) will survive termination.

Governing law

These Terms are governed by the laws of the United States and the State of Ohio, without regard to conflict-of-law rules, except where mandatory consumer protection laws in your country of residence apply. Disputes will be resolved in the state or federal courts located in Ohio, unless applicable law requires otherwise.

Changes

We may update these Terms. We will post the revised version on this page and update the "Last updated" date. Material changes may also be noted in the app or by email where appropriate. Continued use after changes constitutes acceptance.
